The rules of 2wingz

2wingz connects someone who needs a paper document moved with a traveler already making that journey. These terms say what each side promises, what the money does, and what happens when something goes wrong. They are written to be read, not to be survived.
Before publishing: have these checked by a German lawyer. Three points need a decision rather than wording — whether escrowed money makes you a payment service (and whether Stripe Connect carries that licence for you), what the protection fee actually promises and up to what amount, and whether your liability limits survive § 307 BGB. The brackets below mark where your answer goes.
1. Who you are contracting with
2wingz is operated by [LEGAL ENTITY NAME], [ADDRESS] — the full details are in the legal notice. "We" and "us" mean that company. "You" means the person using the app, whether sending a document or carrying one.
2. What 2wingz is, and what it is not
We are a marketplace. We verify identities, hold the payment, provide the app, keep the record of what happened and decide disputes. We do not carry anything. The transport contract is between the sender and the traveler; we are not a courier, freight forwarder or postal service and do not act as one.
This matters for what you can expect from us: we answer for the platform, the escrow and our own decisions, not for a traveler's punctuality or a document's fate in someone else's bag. What we do promise when a shipment goes wrong is in §11 and §12.
3. Who may use it
- You must be 18 or older and legally able to enter contracts.
- One account per person, in your own real name.
- You must pass identity verification before you can post a trip or send a document. Until our team releases your profile you can browse, and nothing more — that restriction is the reason the other side of every handover can be trusted.
- Everything you tell us must be true: your name, your document, your route, and what is inside the envelope.
4. What may be sent — and what may not
2wingz is for paper documents. Contracts, certificates, diplomas, notarised deeds, court papers, visa files, medical records.
Never send, and never agree to carry:
- Cash, cheques, bearer instruments, cards, cryptocurrency keys or anything else that is money.
- Drugs, medicines, weapons, ammunition, or anything dangerous, perishable or living.
- Jewellery, electronics, or valuables of any kind — this is not a parcel service.
- Anything whose export or import is restricted, or that requires a customs declaration.
- Anything unlawful in the country you leave, cross or enter.
- Anything you have not shown honestly in the app.
A traveler may refuse any item, at any moment, without giving a reason, and should refuse anything that is not sealed in their presence or does not match what was described. Carrying something across a border is the traveler's own legal responsibility: you sign the customs form, not us. If you are told an envelope holds papers and it does not, report it before you travel.
Breaking this section ends your account and, where a crime is involved, is reported to the authorities.
5. Booking, the price, and what we take
A traveler names their fee within the range the app allows. Before you pay, the app shows you every line of the price and the total — what you see there is what you are charged. Current amounts are always the ones displayed in the app at the moment of booking; these terms deliberately do not repeat numbers that can change.
Our commission is taken out of the traveler's fee, not added to the sender's price. The traveler sees their earnings after commission before they accept. Nothing is added later, and there are no fees that appear after the fact.
6. The money is held, not sent
- When you book, your payment is authorised and held by our payment provider.
- It is released to the traveler only after the recipient confirms delivery with their code.
- If a problem is reported, the money stays held until our team has decided.
- Card details never reach us: they go directly to Stripe, who processes payments for us.
7. The handover
- The document is sealed and photographed at pickup, with both people present.
- The recipient's delivery code completes the journey. Without the code there is no delivery, and the traveler is not paid — so never share it before the document is in your hands.
- Photographs taken at pickup and delivery are kept as evidence of what was handed over and in what state.
8. Location while carrying
A traveler may share their location while a document is in their custody. It is off until they turn it on, it shows an approximate area unless they choose to share their exact position, and the whole trail is deleted when delivery is confirmed. 9. Cancelling
- Before pickup, either side may cancel in the app. A sender who cancels before pickup is not charged: the hold is released.
- A traveler who can no longer make the trip must say so immediately, so another can be found.
- Repeated cancellations, and not turning up, cost you access to the platform.
- After pickup a shipment can no longer be cancelled — only completed or disputed.
10. Your right of withdrawal
As a consumer you have fourteen days to withdraw from a contract concluded online, without giving a reason. Our service is usually performed at once, though, and you can ask for that: when you book a shipment that begins before the fourteen days are up, you expressly consent to us starting immediately and acknowledge that your right of withdrawal ends once the service has been performed in full. Until then you may still withdraw, and we refund proportionately what has not yet been done.
Before publishing: a formal Widerrufsbelehrung with a model withdrawal form has to accompany this, in the language of your customers, and the app must record that consent at the moment of booking. Ask your lawyer for the current statutory wording — paraphrasing it is exactly what gets challenged.
11. When something goes wrong
Report it from the shipment: Report a problem. The payout freezes at once. Our team looks at the seal photographs, the delivery record, the messages and the location trail, and decides — refund to the sender, release to the traveler, or a split. Both of you are told the outcome and why.
We decide these cases as the platform, not as a court. Nothing in this section takes away your right to go to a court, or to pursue the other party directly.
12. What we are responsible for
- We are liable without limit for injury to life, body or health, for intent and gross negligence, and wherever the Produkthaftungsgesetz applies.
- For ordinary negligence we are liable only where we break an obligation that the contract depends on, and then only for the damage typical of such a contract and foreseeable at the time.
- We are not liable for what a traveler or a sender does, for a document's contents, or for missing a deadline that depends on someone else's journey. Do not send an irreplaceable original under time pressure without a copy.
Before publishing: a lawyer must confirm these limits hold under § 307 BGB — clauses like this are struck out more often than they are upheld, and a struck-out clause leaves you with none.
13. The protection fee
Before publishing: decide precisely what the protection fee buys — what is covered, what is excluded, the maximum amount, who decides and how fast — and write it here. It must not be described as insurance unless it is an insurance product from a licensed insurer; regulators treat that word seriously, and so do both app stores. If it funds a goodwill reimbursement policy, say that plainly and state the cap: [AMOUNT].
14. Suspension
We may suspend or close an account that breaks these terms, that fails verification, that is used for fraud, or whose behaviour puts other people at risk. Money already held is still decided under §11 — we do not keep it.
15. Your data
What we hold and why is in the privacy policy. You can export or erase your account yourself under Account → Privacy & GDPR, or at this page.
16. Changes
If we change these terms we will tell you in the app before the change takes effect, and say what changed. Carrying on using 2wingz after that means you accept them; if you do not, you can close your account and any held payment is settled under the terms you booked under.
17. Law and jurisdiction
German law applies. If you are a consumer, this does not take away the protection of the mandatory law of the country you live in, and you may sue us where you live. If you use 2wingz as a business, the place of jurisdiction is [CITY].
